TERMS AND CONDITIONS

1. General Information

In these Terms and Conditions "We", "Us" and Desyllas” mean Helena Nicole Nominees trading as Desyllas ABN 22 878 187 382, the Website Owner, and "You”, “Your” or “User” means you the customer, visitor or user of the site.

Please read the Terms and Conditions carefully before placing any orders on www.desyllas.com.au

You are bound by the version of Terms and Conditions that are in force at the time you submit the online form confirming your intent to order products from the site.

These Terms and Conditions together with your order constitute the entire contract between us and you for the supply of products. No other Terms and Conditions will apply. The contract may not be altered unless agreed to by us in writing or via email.

Desyllas may at any time amend the Terms and Conditions without prior notice.

3. Territory

Orders may be placed if your billing address, delivery address, and the address corresponding to your credit card are all located in one and the same region.

5. Site Operation

The site is a secure online platform that allows users to place an online order and receive by mail the goods offered for sale.

6. Availability of Products

Images of products on the site are provided for information purposes only. By placing an order, the user is making an offer to Desyllas, and Desyllas has the right but not the obligation to accept or decline the offer. You acknowledge and agree that Desyllas cannot guarantee the availability of a product until the same is ready for delivery to you.

7. Pricing

Product prices are in Australian Dollars (AUD). The currency is automatically assigned according to the region of the delivery addresses.

Products may be subject to duties, tax, postal and other additional costs to transport, import or deliver the product to your region or residence.

 These taxes and costs are independent of Desyllas. You agree to fully bear the costs which will appear before you check out from the online shop.

Desyllas is not responsible for any bank fees or foreign currency charges.

8. Credit Card Fraud

Desyllas will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an un-authorised manner.

9. Order Acceptance

Once an order has been placed with Desyllas online store you are engaged in a contract that sees you unconditionally accept the prices and descriptions of the items you have ordered.

If Desyllas is unable to obtain authorisation for payment or in the case where fraudulent use of credit card is suspected, Desyllas reserves the right to not accept your order.

If the item(s) ordered are out of stock or withdrawn from sale for any reason, or if shipping restrictions apply for the area of delivery, Desyllas reserves the right to not accept your order.

10. Delivery

Products will be delivered exclusively to the address recorded by you in the online form, and you are responsible for the accuracy of that address, and Desyllas endeavours to ship your order as soon as possible after completion of the transaction.

Desyllas shall not be liable for late delivery, damage due to transportation or any other damages directly or indirectly related to the shipment of the products.

11. Return of Products

Return of products will only be accepted for unused products in their original condition.  The shoes must be unmarked and in perfect condition, and returned in the original parcel, the original box and all related accessories included when you opened the parcel such as: shoe wrapping, tissue paper, dust bags, replacement tap-heels, stickers, instructions, booklets, cards, gift with purchase, copy of proof of purchase, etc. If not, you may incur the payment of a fee.

Desyllas reserves the right to refuse any return on merchandise that appears to have been worn, damaged, soiled, altered or anything that Desyllas reasonably believes that has been used.

If your return package is not accepted it will be sent back to you at your expense and no refund will be granted.

When sending a return parcel it is your responsibility until it reaches us. We suggest you return the goods by registered post to ensure delivery.

12. Defects

Desyllas undertakes to ensure the highest quality standards are met in the manufacturing of all products. Any minor imperfections of the product(s) can be the result of the hand-making process and is not to be mistaken as a manufacturing fault.

Every product is inspected and controlled before being shipped to you the customer. If your product shows any defect you shall be responsible for contacting info@desyllas.com.au within five (5) working days from the date of delivery.

In such case, you must indicate alleged defect in an email with supporting evidence, photographs, purchase date, order and invoice number, date of delivery, and delivery receipt.

Desyllas will consider the elements and reserves the right to recover the products to undertake a physical investigation.

In case of a recognised defect, Desyllas shall have the right to either replace the defective product if stock is available, or to partially or fully refund the purchase price to you, depending on the nature and extent of the defect.

If the product(s) is returned for physical investigation, and the investigation does not reveal a defect attributable to Desyllas, the said product(s) will be returned to you at your expense.

13. Liability

Desyllas will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind whatsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.

The maximum aggregate liability for any products supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the products(s) in question.

14. Product Care

In order to keep your shoes in good condition it is recommended that you keep the material clean and dry using a soft cloth, always store your products away from light and heat, store your products in the dust bag or shoe box provided to you when you are not wearing them. Avoid contact with abrasive surfaces, chemicals, etc.

GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of South Australia and shall be subject to the non-exclusive jurisdiction of the courts of South Australia.

PRIVACY POLICY

Desyllas undertakes to protect your privacy and personal data. Your personal data is solely used for statistical purposes to improve the quality of the site. Desyllas will not use your personal data for direct marketing purposes unless you have given informed consent. Desyllas will not sell your personal data. 

Your personal data may be transmitted to financial institutions and/or specialised hosting companies to process payment of your order, and to the carrier in charge of the delivery of goods ordered by you.

OTHER TERMS

Desyllas does not guarantee continuous, uninterrupted or secure access to our website.  Operation of our website may be interfered with or adversely affected by numerous factors or circumstances beyond of our control.
